Terms of Service.

The agreement between you and Foil Racing League.

Effective date: June 25, 2026

These Terms of Service ("Terms") are a binding agreement between you and Foil Racing League ("FRL," "we," "us," or "our") and govern your access to and use of foilracingleague.com, FRL memberships, sanctioned events, clubs, athlete profiles, rankings, and any related services (collectively, the "Services"). By creating an account, purchasing a membership, registering for an event, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and accounts

  • You must be at least 13 years old to create an account. Minors under 18 must have a parent or legal guardian agree to these Terms and any applicable waivers on their behalf.
  • You agree to provide accurate, current, and complete information and to keep it up to date.
  • You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

2. Memberships and tiers

FRL offers multiple membership tiers (Supporter, Competitor, Foil Racing Club, and Race Organizer). Each tier has its own benefits, obligations, and pricing as described on our site. Memberships are personal, non-transferable, and renew automatically unless canceled. We may add, change, or discontinue tiers and pricing on a prospective basis.

3. Sanctioned events, competition, and safety

  • Participation in any FRL-sanctioned event requires a current FRL membership of the appropriate tier, compliance with the FRL Rulebook, and execution of any required waivers and releases.
  • Foiling is an inherently risky water sport. You participate at your own risk and are responsible for your own equipment, fitness, skill, and conduct.
  • FRL, event organizers, officials, and volunteers are not responsible for personal injury, property damage, or loss arising out of participation, except as required by applicable law.
  • Officials may disqualify, penalize, or remove participants for unsafe conduct or rule violations.

4. Clubs and organizers

Clubs and event organizers using FRL agree to follow the FRL Rulebook, safety requirements, and sanctioning procedures. Organizers are responsible for the operation of their events, including permits, insurance, on-water safety, and compliance with local laws. FRL is not a party to any contract between you and a club or organizer.

5. Payments, fees, and refunds

Payments are processed by our payment processor (Stripe). You authorize us and our processor to charge your selected payment method for membership fees, event entries, and other purchases. All amounts are in U.S. dollars unless stated. Refund terms are described in our Refund Policy.

6. User content

You may post photos, profile information, club details, results, and other content ("User Content"). You retain ownership of your User Content. You grant FRL a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and create derivative works of your User Content to operate and promote the Services, the national rankings, and sanctioned events.

You represent that you have all rights necessary to grant this license and that your User Content does not violate any law or third-party right.

7. Acceptable use

You agree not to:

  • Use the Services to violate any law or regulation.
  • Impersonate another person or misrepresent your affiliation with any person or organization.
  • Upload viruses or malicious code, or interfere with the security or integrity of the Services.
  • Scrape, harvest, or mine data from the Services without our written permission.
  • Use the Services to harass, defame, or harm others.
  • Resell or commercialize the Services without our written permission.

8. Intellectual property

The Services, including the FRL name, logos, rulebook, ranking systems, and software, are owned by FRL or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use, subject to these Terms.

9. Third-party services

The Services rely on third-party providers (such as Stripe for payments and Google Maps for location features). Your use of those services is subject to their own terms.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FRL DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OFFICIALS, AND VOLUNTEERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. FRL'S AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FRL IN THE 12 MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

12. Assumption of risk and release

You acknowledge that pump foiling, eFoiling, and on-water competition involve risks including drowning, collision, equipment failure, and serious injury or death. You assume all such risks and release FRL, its affiliated clubs, event organizers, sponsors, officials, and volunteers from all claims arising out of those risks, except for those that cannot be released under applicable law.

13. Indemnification

You agree to indemnify and hold harmless FRL and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your User Content, your participation in events, or your violation of these Terms.

14. Termination

We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms, the Rulebook, or unsafe conduct. You may stop using the Services at any time. Sections that by their nature should survive termination will survive.

15. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or the Services will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction and venue in those courts.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new effective date. Continued use of the Services after changes take effect constitutes acceptance.
