Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Foil Racing League (“FRL,” “we,” “us” or “our”). They govern your use of foilracingleague.com, rider accounts, race registration, VIP passes, merchandise, FRL events such as the Miami Foil GP, and any related services (together, the “Services”). By creating an account, registering for a race, making a purchase, attending an FRL event or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and accounts

• /You must be at least 13 years old to create an account.
• /Riders under 18 cannot register or sign a waiver on their own. A parent or legal guardian must agree to these Terms and sign the rider waiver on their behalf.
• /You agree to give accurate, current and complete information and to keep it up to date.
• /You are responsible for keeping your sign-in details secure and for all activity under your account.

2. Race registration

• /Your entry fee covers entry into one racing division, the official race pullover, your race number and rider kit, and eligibility for the prize purse, as described on the registration page at the time you register.
• /Every rider must sign the FRL rider waiver and release before racing. Your entry is not complete until the waiver is signed and payment is confirmed.
• /Divisions have limited spots and are filled first come, first served. You must enter the division that matches your eligibility, including any age limits. FRL may move or remove a rider entered in the wrong division.
• /Once your entry is paid, you cannot switch divisions on your own. Email us and we will do our best to help.
• /Entries are personal to you and cannot be transferred or resold without our written approval.

3. Race day, rules and safety

• /eFoil racing is an inherently risky water sport. You take part at your own risk and are responsible for your own equipment, battery, fitness, skill and conduct.
• /You must follow the event rules, the rider briefing, and the instructions of race officials, safety boat crews and venue staff at all times.
• /Officials may penalize, disqualify or remove any rider for unsafe conduct, equipment that does not meet event requirements, or rule violations. Officials' decisions on results are final.
• /FRL may change the schedule, race formats, courses or heats, or delay or shorten racing, because of weather, water conditions, safety or venue requirements.

4. Prize money

• /Prize money is paid according to the purse and payout structure posted for the event. Payouts are based on final official results.
• /Winners may need to provide identity and tax information, such as an IRS Form W-9 or W-8, before we can pay out. Winners are responsible for any taxes on their winnings.
• /FRL may withhold or reclaim prize money from a rider who is disqualified or found to have broken the rules.

5. Spectators, VIP passes and event conduct

• /Spectator entry is free unless stated otherwise. Parking and other on-site services are provided on the venue's terms and prices.
• /A VIP Boat Experience pass gives the holder access to the on-water viewing experience described at purchase. Passes are personal and may not be resold. Boat access depends on weather, water conditions and safety decisions made on the day.
• /Everyone at an FRL event must follow venue rules and the instructions of FRL staff, officials and venue staff. We may remove anyone whose behavior is unsafe or disruptive, without refund.
• /FRL events are public and are photographed, filmed and may be broadcast or livestreamed. By attending, you agree that you may appear in this footage and that FRL may use it to cover and promote its events.

6. Payments and refunds

• /Race entries and VIP passes are processed by Stripe. Merchandise orders are processed by Shopify. You authorize us and these processors to charge your chosen payment method. All prices are in U.S. dollars unless stated otherwise.
• /Race entries are non-refundable. This includes when a rider cannot attend, withdraws, is injured, or is disqualified.
• /VIP passes are non-refundable, including when on-water access is limited or cancelled for weather or safety reasons.
• /If FRL cancels an event entirely and does not reschedule it, we will refund race entry and VIP pass fees paid for that event. We are not responsible for travel, lodging or other costs you incur.
• /Merchandise orders are covered by the return terms shown at checkout.

7. Your content and likeness

• /You own the information you add to your rider profile. You give FRL a worldwide, non-exclusive, royalty-free license to use it to run the Services and publish race entries and results.
• /Riders grant FRL the media rights described in the rider waiver, including the right to use their name, image, likeness, voice and race results to cover and promote FRL and its events.

8. Acceptable use

You agree not to:

• /Use the Services to break any law or regulation.
• /Impersonate another person or misrepresent your affiliation with any person or organization.
• /Upload viruses or malicious code, or interfere with the security or operation of the Services.
• /Scrape, harvest or mine data from the Services without our written permission.
• /Use the Services to harass, defame or harm others.
• /Resell entries, passes or any part of the Services without our written permission.

9. Intellectual property

The Services, including the FRL and Miami Foil GP names, logos, event formats, content and software, are owned by FRL or its licensors and are protected by intellectual property laws. We give you a limited, revocable, non-exclusive, non-transferable license to use the Services for your personal, non-commercial use, subject to these Terms. You may not use FRL names or logos without our written permission.

10. Third-party services

The Services rely on third-party providers, including Stripe and Shopify for payments and Google and Apple for sign-in. Your use of those services is subject to their own terms.

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. FRL DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OFFICIALS AND VOLUNTEERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. FRL'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FRL IN THE 12 MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

13. Assumption of risk and release

You acknowledge that eFoiling and on-water racing involve risks including drowning, collision, falls at speed, equipment failure, battery fire, and serious injury or death. You assume all such risks and release FRL, its venue partners, sponsors, officials and volunteers from all claims arising out of those risks, except claims that cannot be released under applicable law. Riders are also bound by the separate rider waiver and release they sign when registering.

14. Indemnification

You agree to indemnify and hold harmless FRL and its officers, directors, employees, officials, volunteers, venue partners and sponsors from any claims, damages, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your participation in or attendance at an event, or your violation of these Terms.

15. Termination

We may suspend or close your account, or refuse or cancel an entry, if you break these Terms or the event rules or act unsafely. You may stop using the Services at any time. Sections that by their nature should survive termination will survive.

16. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising out of or related to these Terms or the Services will be brought only in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction and venue in those courts.

17. Changes to these Terms

We may update these Terms from time to time. We will post changes on this page and update the effective date. Continued use of the Services after changes take effect means you accept the updated Terms.
